Doing an end run around the City Council, which has supported his other public-health initiatives, was bound to generate a backlash. And there seems to be little doubt Judge Tingling had this in mind when he issued his mixed-message ruling.</p>
<p>The point is that it&#8217;s going to be an uphill legal battle and there are more important fights. We support the ban, but we have to ask if this is the best use of city resources.
